Until confirmation is issued, the selected date remains available to other enquiries.
2. PAYMENT TERMS
The Couple agrees to pay the confirmed Venue Hire Fee in accordance with the tiered pricing applicable to the selected date and package at the time of booking.
The full contractual amount must be paid in full no later than one hundred and twenty (120) days prior to the wedding date.

Acceleration: Upon cancellation for payment default, the full unpaid balance of the Venue Hire Fee shall become immediately due and payable.
Cancellation due to payment default does not release the Couple from liability for the full contractual amount. The Venue reserves the right to recover any outstanding monies as a debt due, including reasonable recovery costs.
3. CANCELLATION & REFUND POLICY
All deposits and instalments are non-refundable.
- Cancellations made within one hundred and twenty (120) days of the event date will result in forfeiture of all monies paid.
- Cancellations made more than one hundred and twenty (120) days prior to the event date will result in forfeiture of all deposits paid.
Waterfall Wedding operates as an exclusive-use property hosting one event per day. Once a date is reserved, it is removed from availability.
4. UNFORESEEN CIRCUMSTANCES
The Venue shall not be liable for delay, interruption, cancellation, or inability to provide the venue due to circumstances beyond its reasonable control, including but not limited to fire, flood, severe weather, natural disaster, government directive, infrastructure failure, access restrictions, or other force majeure events.
If the Couple elects not to proceed due to such circumstances, the booking will be treated as a cancellation under this Agreement and all applicable cancellation terms will apply.
If the Venue is physically unable to provide the venue due to destruction of the property or permanent structural unavailability, the Venue’s liability shall be strictly limited to a refund of monies paid under this Agreement. No further compensation, damages, loss of profits, or consequential loss shall be payable. The refund of monies paid constitutes the sole and exclusive remedy available to the Couple in such circumstances.
Any request to transfer to a future date will be treated as a new booking, subject to availability and pricing applicable at that time.
5. VENUE OBLIGATIONS
The Venue will provide exclusive access to the property in accordance with the agreed package and ensure the premises are presented in a clean, safe, and fit-for-purpose condition.
The Venue reserves the right to enforce all safety regulations, noise restrictions, curfews, and responsible service requirements as required under NSW law.
6. COUPLE OBLIGATIONS
The Couple agrees:
- to comply with all Venue policies and directions provided by Venue staff;
- to ensure guests and suppliers comply with all safety and operational requirements;
- to be responsible for any damage caused by guests or suppliers; and
- to indemnify the Venue against claims, damage, loss, or liability arising from the conduct of guests or suppliers, except to the extent caused by the Venue’s proven negligence.
7. LIABILITY & INSURANCE
The Venue maintains public liability insurance covering injury or loss caused solely by the Venue’s proven negligence.
This insurance does not cover event cancellation, postponement, supplier failure, weather events, government restrictions, guest-related incidents, or other external circumstances.
The Couple is required to obtain appropriate wedding or event insurance to protect against financial loss arising from cancellation, postponement, supplier failure, natural events, or other unforeseen disruptions.
Wedding and event insurance policies are widely available in Australia and typically range between $250 and $500, depending on the level of cover selected.
The Venue shall not be responsible for losses that would ordinarily be covered by event insurance.
The Venue may require evidence of such insurance prior to the event date. Failure by the Couple to obtain such insurance does not alter the allocation of risk under this Agreement.
8. INFRASTRUCTURE & WEATHER
The Venue provides access to agreed facilities and infrastructure as outlined in the selected package. Outdoor ceremonies and receptions are weather dependent unless a separate wet weather option has been formally arranged.
The Venue is not responsible for adverse weather conditions or the impact of such conditions on event styling or guest comfort. The Couple acknowledges that the Venue is an outdoor rural property and accepts inherent environmental conditions.
9. NOISE, CURFEW & EVENT CONTROL
All events must comply with local council and environmental noise regulations.
Music must cease at the agreed curfew time specified in the confirmed booking.
The Venue reserves the right to reduce volume levels or direct the cessation of music or service if noise limits are exceeded or regulatory compliance is at risk.
Failure to comply with reasonable directions from the Venue may result in immediate suspension of entertainment or service activities. The Venue shall not be liable for any loss arising from enforcement of regulatory compliance or safety directions.
10. SECURITY BOND
A refundable security bond may be required prior to the event date. If required, the bond amount will be confirmed in writing prior to confirmation of the booking.
The bond may be applied toward:
- damage to property or infrastructure;
- excessive cleaning;
- waste removal beyond normal event use;
- breach of noise or compliance conditions; and
- unauthorised use of restricted areas.
Any remaining bond balance will be refunded within fourteen (14) days following the event, subject to inspection.
11. GUEST CAPACITY
The maximum guest capacity permitted under this Agreement will be specified in the confirmed booking documentation.
The Couple must not exceed the approved guest number at any time.
The Venue reserves the right to refuse entry to additional guests or take necessary action to ensure compliance with safety regulations.
12. SUPPLIER ACCESS & LIABILITY
All suppliers engaged by the Couple must comply with Venue access times, bump-in and bump-out schedules, and operational requirements.
Suppliers must hold appropriate public liability insurance and may be required to provide certificates of currency.
The Couple is responsible for supplier conduct and any damage caused during bump-in, service, or bump-out.
The Venue is not responsible for supplier performance, delays, or contractual disputes between the Couple and third-party providers.
13. GOVERNING LAW
This Agreement is governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
14. ASSIGNMENT
This Agreement is personal to the Couple and may not be assigned, transferred, or resold without the prior written consent of the Venue.
